Delivery: Title and Risk of Loss

Title to product(s) passes from AUS to you upon shipment from AUS facilities. Loss or damage occurring during shipping is your responsibility. If AUS is providing shipping, insurance may be purchased through AUS at the time of purchase to cover liability limits as defined by you.

This agreement shall be governed by the laws of the State of Oklahoma without regard to its conflict of law principles. Unless exemption documentation is provided to AUS prior to the sale, all sales are subject to applicable local and state taxes. All international orders are subject to applicable taxes, duties, and tariffs.

Exchanges

When an item is sold on an “EXCHANGE” basis, the customer must return a like repairable item. Exchanges must be received by Advanced Ultrasound Systems (AUS) no later than fifteen (15) days from the original shipment date.

Failure to return the item — or returning an item that is not repairable — will result in additional billing up to the full OEM replacement cost. AUS will inspect all exchange items and reserves the right to accept or reject any based on repairability.

Parts Return Policy

If you are returning an item for credit, you must contact AUS for approval prior to the return. Items returned for credit are subject to a 20% restocking fee if received within five (5) days of the ship date, unless otherwise stated; 30% if received after five (5) but within fifteen (15) days. Items received after fifteen (15) days will not receive credit.

All items in OEM packaging must be returned with the original packaging to receive credit.

Definition of a Repairable Item

1) Any PCB, power supply, monitor, or probe received with all original components in place after initial evaluation, meeting OEM specifications; 2)Any item free from defects that would prevent reasonable repair. 3) Any item containing all original software, flash code, and/or ID chips.

Definition of an “Unrepairable” Item

  1. Any item that has been altered, tampered with, or shows signs of unskilled repair preventing its use or repair.
  2. Items with unrepairable damage to multiple PCB layers.
  3. Severe scorching or burning visible upon inspection.
  4. Items severely crushed or broken (e.g., damaged insertion tube on a TEE Probe).
  5. Probes requiring new arrays when replacement arrays are not available in the USA.
  6. Items whose repair cost exceeds a reasonable exchange price.
  7. Clones or non-OEM parts will not be accepted.

Unless a prior written agreement is in place, all items returned as Defective on Arrival (DOA) must be received by AUS within five (5) days of shipment. Items received after this period will incur a 20% late/restocking fee. Failure to return a repairable item will result in additional billing.

Warranty

AUS warrants all PCB replacements for 90 days and probe replacements for 30 days from the shipment date — unless otherwise stated — against failure in materials or workmanship. In case of failure, AUS will provide a replacement part from stock if available. If unavailable, customers may choose to send the item in for express repair.

This warranty does not cover accidental damage or misuse as determined by AUS. Warranty is valid only if all payments and exchange items have been received.

The failed part must be returned within five (5) days of receiving the replacement. Upon return, an evaluation will be conducted to determine warranty eligibility. If the item fails the evaluation, an invoice will be issued reflecting the cost of the item as an exchange.
